July 4 fatal-crash reports could go to prosecutor by Sept. 12

Reports related to the July 4 fatal collision between a North Kitsap Fire & Rescue engine and a Yamaha scooter could be forwarded to the Kitsap County prosecutor’s office by Sept. 12.

POULSBO — All reports related to the July 4 fatal collision between a North Kitsap Fire & Rescue engine and a Yamaha scooter could be forwarded to the Kitsap County prosecutor’s office by Sept. 12.

That’s according to Kitsap County sheriff’s spokesman Deputy Scott Wilson, who said on Sept. 5 that investigators are awaiting the toxicology report on the driver of the scooter.

A toxicology report, conducted by the Washington State Patrol’s crime lab, usually takes eight weeks, Wilson said.

Wilson said the crime lab is busy. “What’s happening here is happening in how many jurisdictions in the state,” he said. Additionally, the lab’s resources were temporarily diverted to the processing of DNA tests during the investigation into the murder of 6-year-old Jenise Wright of East Bremerton last month.

“[Investigators] expect — meaning it’s possible but not concrete — they expect to have the whole package assembled and to prosecutors by this time next week,” Wilson said of the investigation into the July 4 crash.

The driver of the scooter — Jason T. Foster, 48, of Kingston — was declared dead at the scene, at Miller Bay and West Kingston roads.

Foster was traveling north on Miller Bay Road, according to a preliminary report from the sheriff’s office. The fire engine, driven by a 36-year-old firefighter, was headed southbound on Miller Bay Road.

The fire engine slowed in the intersection to make a left turn onto West Kingston Road. The scooter and the front left of the fire engine collided in the middle of the intersection, according to the report.

The crash was reported at 11:02 a.m.

Sheriff’s investigators took witness statements, measurements, photos of the scene, and analyzed the traffic signal at the intersection, Wilson said earlier.

Two people were aboard the fire engine — the driver, who has been with the department for two years; and an engine officer who has been with the department for 15 years, according to NKF&R. The firefighters were not injured and were placed off duty during the investigation, according to NKF&R.

The firefighters were reportedly returning to their station after responding to a residential structure fire, Wilson said.
