PORT ORCHARD — The defense attorney for the 18-year-old who allegedly made threats of violent acts against Kingston High School has not approached the Prosecuting Attorney’s Office to negotiate the case in the three months since the teen was booked into county jail.

Matthew Allen Smiley was booked Sept. 5 after people warned that he had allegedly made threats to shoot a gun at the school. He remains in county jail on $2 million bail.

Smiley is scheduled to appear in court Dec. 18, according to Barbara Dennis, the deputy prosecuting attorney handling the case. She said she expects the case will be moved to Superior Court. However, she has not heard anything from Smiley’s defense attorney, she said.

“The defense has not come forward to negotiate the case at all,” Dennis said. Smiley’s defense is being handled by the Law Offices of John Henry Browne, P.S., according to Dennis.

A woman at the law office confirmed it is the defense for Smiley “as an entity.” No attorney from the law office returned a message left by the North Kitsap Herald.

Dennis said she hopes there will be “as least some movement” during the scheduled court date Dec. 18.

Smiley has been in jail since he was first arrested at his parents’ home in Kingston. He is being held for felony harassment. Because he is a first-time offender as an adult, Dennis said the time he has served will count toward whatever — if any — his sentence is.

“He’s only looking at one to three months,” she said.

Also still in jail is Sebastian Khalil Carroll, who was booked Sept. 9 for felony harassment and escape from community custody. There is no bail.

Carroll, 19, was arrested at the Bremerton Department of Corrections Office. Carroll was allegedly involved with threats to harm witnesses in the Smiley case, following Smiley’s arrest. He was one of four arrested Sept. 9 for felony harassment and/or intimidating witnesses. The other three were juveniles who were booked into the juvenile detention center, received various sentences, and released.
