The trial for the Kitsap County lawsuit claiming the  Kitsap Rifle and Revolver Club is a nuisance and danger has been moved again.

Now set to begin on Sept. 27, the trial is expected to last two weeks and will occur in Pierce County Superior Court. The most recent start date was Sept. 19 after being bumped in August and an original March trial date.

In September 2010, Kitsap County Prosecutor Russell Hauge filed the lawsuit against the Seabeck-area gun club for allegedly violating nuisances laws following a spate of noise and safety complaints by neighbors.

The most recent trial delay comes from a tight schedule according to Kitsap County deputy prosecutor Neil Wachter.  The judge has an ongoing criminal trial, he said.

“Criminal issues tend to always trump any civil litigation matter,” added Marcus Carter, executive officer of the gun club.

Wachter said that the county is bringing in a new expert, a forensic expert, and that the defending party has been notified.

Carter said Monday that he was unsure if the club was planning to hire a countering expert.

“We certainly don’t want to spend more money. It’s going to be a matter on what we see in the report,” he said.

The court indicated some flexibility if the defense needs extra time to respond, Wachter said.

“The court is very interested in getting this trial off the ground,” he said.

The club hopes the trial will begin next week and not be pushed back any further, said Carter.

“We’d just like to get through it and be done with it,” Carter said.
