Man thought to be a Sailor faces rape charge in Kitsap County District Court

Nikolai Emmanuael Baker, 23, who appears to be a Sailor in the U.S. Navy and whose home address is in the 2200 block of Scorpion Avenue at Sub Base Bangor, was charged Monday in Kitsap County District Court with rape in the third degree.

A spokesman from Navy Region Northwest was not immediately able to confirm whether or not Baker serves in the U.S. Navy or not.

According to court documents, Baker was at a home in Bremerton and started drinking with a man and his wife at around 10 p.m. July 5 and the drinking continued into the next morning. The woman said she threw up around 2 a.m. and went to bed around 3 a.m. The husband said he and Baker stayed up playing video games and drinking until about 4 a.m. when he went to bed, but Baker stayed up playing games.

Eventually, at around 5 a.m., the woman said she awoke and realized she was being sexually assaulted and then woke her sleeping husband. He apparently grabbed a gun, but didn’t aim it at Baker, and shooed him out of the room. He says he subsequently confronted Baker who denied being in the room and left the residence. His wife later told him what happened and they contacted police.

A sheriff’s office deputy then set out to find Baker.

“I went to Bangor to locate Nikolai Baker, but he was not there,” the deputy wrote. “I later received a call that the military had him and told me that I could come and interview him. I responded and interviewed Baker in Lt. Commander Faller’s office.”

Baker said that during the incident, on a drunken scale of 1 to 10, with 10 being the most drunk, he was at the level of 9. He said he drove back to base after leaving the Bremerton home and passed out in his car.

According to the deputy’s report, Baker said that he was bored and went into the room to wake up his “friends of four years.” He allegedly admitted to fondling the woman’s breast while she was not awake or responsive, but said he didn’t remember doing anything more.

“I asked Baker if she gave any sign of wanting him to touch her,” the deputy wrote in his report. “Baker said no, she was asleep. I asked if they ever had a relationship. Baker said no, they were just friends for four years.”

Baker allegedly told the deputy it was possible he went further than fondling the woman’s breast, as she had claimed he did, but he couldn’t remember for sure.

“I asked him why he would do this,” the deputy wrote. “He said that he didn’t know, maybe it was the alcohol.”
