Judge Stephen J. Holman this week set bail at $50,000 for a 22-year-old Port Orchard man accused of rape in the second degree.

The same suspect had been arrested for third-degree malicious mischief on March 12. Around 10:58 p.m., that day, Port Orchard police arrived at a Myhre’s Restaurant on Bay Street and met with the man’s ex-girlfriend.

She said she had seen her boyfriend and went outside to her car. He followed her, she said.

She sat in the driver’s seat while he spoke with several other people in their group, then he “was at the driver’s door and leaned in, wanting a kiss,” according to the statement of probable cause.

“(She) told him, ‘no,’” according to the statement. “He wanted to know why she wouldn’t be with him, and she told him she didn’t love him.”

Then, she said, he stood up and allegedly punched her driver’s mirror, damaging it.

Then on May 1, police received a report that he had raped a 20-year-old woman.

The woman reported she had been “extremely intoxicated, to the degree that she was vomiting and at times during the morning she lost presence of mind.”

But she said she remembered telling the man that she didn’t want to go into his bedroom.

A witness allegedly said she saw him drag her into the bedroom, and she heard the victim yelling “no” and “ouch.”

Police arrested the man, and his bail was initially set at $150,000.

Holman subsequently reduced it to $50,000, considering that he’s worked for his father’s company for six years, he’s lived in the area for his whole life and he has no known criminal conviction history.

His father attended the hearing at which the bail was set, and promised he’d monitor his son to make sure he didn’t get into trouble again.
